for the use of Struss & Claussen services
Contractual terms for our offers and services
§ 1 Scope of Application
- These General Terms and Conditions (GTC) govern all contracts concluded by Struss und Claussen Personal Development, Partnerschaft, Diplom-Kauffrau und Wirtschaftspsychologe, Moorfuhrtweg 15, 22301 Hamburg (hereinafter referred to as Struss & Claussen) with its customers.
- For the purposes of these General Terms and Conditions, a customer is the contractual partner of Struss & Claussen. Offers for digitally available services are directed exclusively at private individuals residing in Germany.
- For the purposes of these General Terms and Conditions, a client is the person for whom the services provided by Struss & Claussen are rendered.
- Struss & Claussen reserves the right to change these GTC at any time without prior notice.
- Divergent, conflicting, or supplementary general terms and conditions shall not become part of the contract unless Struss & Claussen expressly agrees to their validity in writing.
§ 2 Conclusion of Contract
- Contracts concluded between Struss & Claussen and the client are service contracts, unless otherwise expressly agreed upon by the parties. The subject of the contract is therefore the provision of the agreed services, not the achievement of a specific result. In particular, Struss & Claussen does not owe the customer or the client any specific professional or economic outcome. The evaluations and analyses provided by Struss & Claussen are intended solely to assist the customer and/or client in their decision-making process and cannot replace it under any circumstances.
- Contracts between Struss & Claussen and the customer are concluded
- via the Struss & Claussen website www.strussundclaussen.de
- by telephone or via email correspondence between the customer and Struss & Claussen based on an offer from Struss & Claussen
- or by signing a written contract on-site.
- If the contract is to be concluded via the Struss & Claussen website, prior registration by the customer is required. For this, the customer needs an email address and a secure password of their choosing. By registering for the free "trial test," a user account is created for the customer. After completing the "trial test," the analysis of the test results is sent to the customer via email to the email address provided. These General Terms and Conditions form the basis for the free services. By registering for a paid service, a user account is created for the customer. After logging in, the digitally available services ("Online Test"; "Online Coaching Course") are presented to the customer. The customer can then choose from the services presented. These General Terms and Conditions also form the basis for the paid services. Before concluding the contract, the customer is informed about the respective product, the price, and the payment terms. By clicking the "order with obligation to pay" button, the customer declares their intention to conclude a contract for the selected paid service based on these General Terms and Conditions (offer). However, this offer can only be submitted and transmitted to Struss & Claussen if the customer agrees to the General Terms and Conditions of Struss & Claussen. Should the customer wish to book the "Online Coaching Course" less than 14 days before the start of the course, the offer can only be submitted if the customer agrees that the course will begin before the end of the cancellation period and that, in the event of cancellation, they will provide compensation for the services already rendered. The contractual relationship is established upon acceptance of this offer by Struss & Claussen via email to the customer, in which Struss & Claussen transmits the contract text (namely the order content, General Terms and Conditions, and cancellation policy) to the customer.
- If the contract is to be concluded via email, the customer sends an email to Struss & Claussen stating that they wish to commission a service from Struss & Claussen. Struss & Claussen will then send the customer an offer for a service tailored to them or the client, including the price, payment terms, these General Terms and Conditions, and a cancellation policy. The customer then accepts the offer by email to Struss & Claussen.
- If the contract is to be concluded at the business premises of Struss & Claussen, Struss & Claussen will provide the customer with an offer specifically tailored to them or the client on-site, which the customer accepts by signing the contract, thereby incorporating these General Terms and Conditions.
- The contract language is German.

Section 4 Services
- The services provided by Struss & Claussen are based on the service descriptions listed on the Struss & Claussen website.
- An agreed appointment can be canceled free of charge up to five working days in advance; thereafter, only upon proof of illness.
- The service provided by Struss & Claussen is considered to have been rendered in accordance with the contract once Struss & Claussen presents the corresponding evaluation to the customer after analyzing the information.
Section 5 Distinction from Psychotherapy
Our services – including consultations, personal coaching, online masterclasses such as the online coaching course "Inner Voice, Inner Choice" (IVIC), and webinars – do not constitute psychotherapy and are not a substitute for it. These are not medical, psychiatric, or psychotherapeutic treatments, but rather offerings to promote personal development, self-awareness, and decision-making skills. The content – whether in individual settings or within the framework of group, video, audio, test, or workbook formats – is aimed at mentally stable individuals and assumes the ability for self-reflection. Psychotherapy is problem- and symptom-oriented and aims to treat and cure mental illnesses. Our services, on the other hand, are solution-oriented and aim to strengthen personal resources, activate individual potential, and shape the present and future. If interested parties are currently suffering from a mental illness or suspect they may be, we strongly recommend seeking professional therapeutic or medical help.
Section 6 Anti-Sect Declaration
Struss & Claussen hereby declares that it does not work in any way according to the "technology" of L. Ron Hubbard (founder of the Scientology organization). No training of Struss & Claussen consultants according to the aforementioned "technology" has taken place. None of the consultants attend or have attended courses of the Scientology organization. Furthermore, Struss & Claussen rejects sectarian practices of any kind and expressly distances itself from them.
Section 7 Payment
- Customers can pay Struss & Claussen by invoice. The online coaching course can be paid for by credit card or PayPal.
- Payment of the fee is due immediately upon conclusion of the contract. If the due date for payment is determined by the calendar, the customer is already in default upon missing the deadline. In the event of late payment, the customer must pay Struss & Claussen default interest at a rate of 5 percentage points above the respective base interest rate.
- The customer's obligation to pay default interest does not preclude the assertion of further damages for delay by Struss & Claussen.
- If, after the conclusion of the contract, circumstances become known to Struss & Claussen that are likely to significantly reduce the customer's creditworthiness and jeopardize the payment of the fee, Struss & Claussen is entitled to perform or provide outstanding services only against advance payment or the provision of security, and – if necessary after setting a deadline – to withdraw from the contract.
- Set-offs and the assertion of rights of retention are only permitted if the customer's counterclaim is undisputed by Struss & Claussen, acknowledged in writing, or established by a final court judgment.
Section 8 Liability
- Customer claims for damages are excluded. This does not apply to claims for damages by the customer arising from injury to life, limb, or health, or from the breach of essential contractual obligations (cardinal duties), nor to liability for other damages based on an intentional or grossly negligent breach of duty by Struss & Claussen, its legal representatives, or vicarious agents. Essential contractual obligations are those whose fulfillment is necessary to achieve the purpose of the contract.
- In the event of a breach of essential contractual obligations, Struss & Claussen shall only be liable for foreseeable damage typical of the contract if such damage was caused by simple negligence, unless the customer's claims for damages arise from injury to life, limb, or health.
- The limitations in paragraphs 1 and 2 also apply to the benefit of the legal representatives and vicarious agents of Struss & Claussen if claims are asserted directly against them.
- These limitations of liability apply to all claims for damages, regardless of the legal basis.
